Child Custody

Let’s face it.  Disputes over the custody and parenting of a child do not belong in court.  It is truly in the best interests of all concerned parties to resolve these disputes cooperatively with the help of a mediator.  Sometimes, unfortunately, a parent has no choice but to take a custody dispute to court.  Sometimes litigation is unavoidable.  Sometimes the other party refuses to compromise and mediation goes nowhere.

At Majority Law, we firmly believe that custody and parenting time disputes should be resolved without resorting to litigation.  Litigation always increases stress and animosity between the parties.  It deepens the wounds that are already there and makes it more difficult, in the long run, to regain the trust and respect that are necessary for effective co-parenting.  Litigation also ends up disempowering the parties by placing the final decision in the hands of a judge.  A cooperative resolution achieved through mediation, on the other hand, leaves the final decision where it truly belongs, in the hands of the parents.  Such a resolution can be a healing and empowering experience for everyone involved.

Most courts require that parties attend a mediation program to try and resolve their differences cooperatively before appearing in court.  The mediation program is paid for with the parties’ court filing fees.  Majority Law urges clients to take full advantage of mediation.

Our top priority is to achieve our clients’ goals without litigation.  We try to accomplish this by working collaboratively with our clients and with the other parties’ attorneys.  If we achieve all or most of a client’s goals without fighting the other party in court, we will consider that a huge success.
